			<content:encoded><![CDATA[<p style="text-align:left;" align="center">Missing <a class="zem_slink" title="Mortgage loan" href="http://en.wikipedia.org/wiki/Mortgage_loan" rel="wikipedia">mortgage</a> payments will hurt your <a class="zem_slink" title="Credit score" href="http://en.wikipedia.org/wiki/Credit_score" rel="wikipedia">credit score</a>, that is a given. However, as the number of <a class="zem_slink" title="SHORT SALES: An Ethical Approach" href="http://www.amazon.com/SHORT-SALES-Approach-David-Petrovich/dp/1411698681%3FSubscriptionId%3D0G81C5DAZ03ZR9WH9X82%26tag%3Dzemanta-20%26linkCode%3Dxm2%26camp%3D2025%26creative%3D165953%26creativeASIN%3D1411698681" rel="amazon">short sales</a> and <a class="zem_slink" title="Foreclosure" href="http://en.wikipedia.org/wiki/Foreclosure" rel="wikipedia">foreclosures</a> has increased over the past few years, the question has been just how much missing payments on your mortgage affects your credit score.</p>
<p style="text-align:left;" align="center">In a recent report from Fair Isaac, the company that developed <a class="zem_slink" title="NYSE: FICO" href="http://www.google.com/finance?q=NYSE:FICO" rel="googlefinance">FICO</a> scores, estimates were revealed for some of the point score declines following various mortgage delinquency scenarios.</p>
<p style="text-align:left;" align="center">Here are the average hit your credit will take in each of these scenarios:</p>
<p style="text-align:left;" align="center">30 days late: 40 &#8211; 110 points</p>
<p style="text-align:left;" align="center">90 days late: 70 &#8211; 135 points</p>
<p style="text-align:left;" align="center">Foreclosure, <a class="zem_slink" title="Short sale (real estate)" href="http://en.wikipedia.org/wiki/Short_sale_%28real_estate%29" rel="wikipedia">Short Sale</a> or <a class="zem_slink" title="Deed in lieu of foreclosure" href="http://en.wikipedia.org/wiki/Deed_in_lieu_of_foreclosure" rel="wikipedia">Deed-In-Lieu of Foreclosure</a>: 85 &#8211; 160</p>
<p style="text-align:left;" align="center"><a class="zem_slink" title="Bankruptcy" href="http://en.wikipedia.org/wiki/Bankruptcy" rel="wikipedia">Bankruptcy</a>: 130 &#8211; 240</p>
<p style="text-align:left;" align="center">The reports indicate that even one missed mortgage payment can have a significant impact on the credit score of a borrower, but the real tipping point comes when accounts get to 90 days or later past due, as statistics show that this is when accounts are least likely to ever be paid current again.</p>
<p style="text-align:left;" align="center">Of course, other factors come into play as well.  As someone with limited credit will be hurt more, then someone with a large amount of accounts and a good long-standing history may be affected differently as well.</p>
<p style="text-align:left;" align="center">In addition, someone with a less than perfect <a class="zem_slink" title="Credit history" href="http://en.wikipedia.org/wiki/Credit_history" rel="wikipedia">credit history</a> and a lower score may also have less room to drop then a person with a higher credit score as well.</p>
<p style="text-align:left;" align="center">In a note interesting to the current state of the market, it was revealed that even if a borrower were able to walk away from their home with a short sale or deed in lieu of foreclosure and not necessarily miss many payments, their credit score could still be hurt significantly.  That is because if it is reported that the account was settled for less than the full balance, a serious delinquency is calculated into the person&#8217;s credit score, regardless of how many payments they missed.</p>
<p style="text-align:left;" align="center">Of course, the absolute biggest effect on credit score occurs in cases of bankruptcy as the credit bureaus treat this with the biggest impact on credit scores.</p>
<p style="text-align:left;" align="center">While none of this news is information that may come as a major surprise, this is the first release of estimates of the effects of foreclosure and short sales on borrowers credit reports.  For those that unfortunately have to deal with these hardships it will definitely take a major toll in the short-term on credit.  However, like with most things, with the proper management, you credit score can rebound with solid financial planning and responsibility going forward.  After a hardship home ownership can occur within just a few short years with the right planning.</p>
<p style="text-align:left;" align="center">It&#8217;s always best to consult with a Realtor, a mortgage professional, your <a class="zem_slink" title="Certified Public Accountant" href="http://en.wikipedia.org/wiki/Certified_Public_Accountant" rel="wikipedia">CPA</a>, and a real estate attorney, when it&#8217;s time for you to consider missing your first mortgage payment or the thought arises that a short sale may be a viable option for you.  It doesn&#8217;t cost a thing to pick up the phone and set a time for a brief consultation.  So I recommend making the calls.  If you&#8217;re going to do it, then you have the right to make an informed decision backed with careful planning, so you can plan ahead and get to stable grounds sooner rather than later.</p>

			<content:encoded><![CDATA[<p>The Obama administration is considering a plan that would take foreclosed homes off the market and rent them out&#8211;in a move aimed at clearing the glut of unsold foreclosed homes and preventing home values from falling any more, The Wall Street Journal reports.</p>
<p>The talks come at a time when national rents are on the rise and home prices have been falling. By taking advantage of these higher rents, lenders would be able to cover the costs of holding the properties until the homes can be resold once the market stabilizes, and maybe even make a profit on it later, experts note.</p>
<p>Nationally, sales of distressed homes, which are often sold at steep discounts, continue to pull down home values. Removing some of the high number of foreclosed homes for sale is “worth looking at,” Federal Reserve Chairman Ben Bernanke said last week in testimony to Congress.</p>
<p>Just reducing Fannie Mae and Freddie Mac’s foreclosed property sales from its current rate of 50,000 each month to 30,000 could lessen total distressed sales by one-third and help avoid a further 3 percent to 5 percent decline in home prices, analysts at Credit Suisse estimate.</p>
<p>However, turning foreclosed homes into rentals could place lenders and the government in an unknown role of playing landlord.</p>
<p>Another idea being tossed around, according to The Wall Street Journal: Federal officials selling thousands of foreclosed properties to private investors who would agree to rent them out, and who could then work with property management firms and handle the day-to-day tenant demands.</p>

<p>Effective August 20<sup>th</sup>, <a class="zem_slink" title="Fannie Mae" href="http://www.fanniemae.com/" rel="homepage">Fannie Mae</a>’s Desktop Underwriter (which is responsible for the approval of the majority of mortgages today) is being updated to DECLINE more loans that have over an 80% <a class="zem_slink" title="Loan-to-value ratio" href="http://en.wikipedia.org/wiki/Loan-to-value_ratio" rel="wikipedia">loan to value</a> and/or debt ratios higher than 45%.  This is big news since the majority of buyers today are putting down less than 20% and <a class="zem_slink" title="Debt ratio" href="http://en.wikipedia.org/wiki/Debt_ratio" rel="wikipedia">debt ratio</a> is always an area of concern.  </p>
<p>Thanks a bl**dy lot!  As if it wasnt already hard enough for a poor chap to qualify for a mortgage.  Now we have to worry about this too?  Seller financing anyone???  Oh &#8211; I forgot &#8211; Dodd Frank Bill will probably abolish that too.  A little help here Mr. President&#8230;!!??</p>

<p><strong>The <a class="zem_slink" title="Federal Trade Commission" href="http://www.ftc.gov/" rel="homepage">Federal Trade Commission</a> has announced that it will not <a class="zem_slink" title="Police" href="http://en.wikipedia.org/wiki/Police" rel="wikipedia">enforce</a> most MARS Rule provisions against Short Sale Brokers and will transfer MARS <a class="zem_slink" title="Rulemaking" href="http://en.wikipedia.org/wiki/Rulemaking" rel="wikipedia">rule making</a> <a class="zem_slink" title="Authority" href="http://en.wikipedia.org/wiki/Authority" rel="wikipedia">authority</a> to the <a class="zem_slink" title="Dodd–Frank Wall Street Reform and Consumer Protection Act" href="http://en.wikipedia.org/wiki/Dodd%E2%80%93Frank_Wall_Street_Reform_and_Consumer_Protection_Act" rel="wikipedia">Consumer Financial Protection Bureau</a> on July 21, 2011.</strong></p>
<p>The Federal Trade Commission (“FTC”) announced that it will not enforce most of the provisions of the<strong> </strong>Mortgage Assistance Relief Services (“MARS”) Rule against Short Sale Brokers. (See, <em>FTC Press Release: 07/15/2011</em> at <a title="http://www.ftc.gov/opa/2011/07/mars.shtm" href="http://www2.realtoractioncenter.com/site/R?i=8TzFZlLpGO7qp0wwK6ZQqA.." target="_blank">www.ftc.gov/opa/2011/07/mars.shtm</a>). </p>
<p>The FTC MARS Enforcement Policy states: </p>
<p><em>Until further notice, the Commission will forbear from taking any enforcement action for violation of the MARS Rule with the exception of the Rule’s prohibition against misrepresentations in Section 322.3(b) against a <a class="zem_slink" title="Real estate" href="http://en.wikipedia.org/wiki/Real_estate" rel="wikipedia">real estate</a> professional who provides “any service, plan, or program, offered or provided to the consumer in exchange for consideration, that is represented, expressly or by implication, to assist or attempt to assist the consumer [in] . . . [n]egotiating, [o]btaining or [a]rranging . . . [a] short sale of a dwelling.”(footnote omitted)</em></p>
<p>Notably, the FTC Enforcement Policy also states: </p>
<p><em>Additionally, on July 21, 2011, the Commission’s rulemaking authority with respect to the MARS Rule will transfer to the (CFPB) (footnote omitted).   Thus, the CFPB will have the authority to determine whether any modification of the MARS Rule is warranted with respect to real estate professionals who assist a consumer in negotiating or obtaining a short sale.</em></p>

<p>What does this mean?  It means that the MARS Rule has not yet been revised or repealed.  The FTC is stating that it will not enforce the MARS Rule disclosure and advance fee provisions against brokers assisting a seller in a short sale transaction at this time.</p>
<p>Short sale brokers still must comply with <a class="zem_slink" title="Arizona" href="http://maps.google.com/maps?ll=34.0,-112.0&amp;spn=3.0,3.0&amp;q=34.0,-112.0 (Arizona)&amp;t=h" rel="geolocation">Arizona</a> state law, which prohibits a real estate licensee from receiving additional compensation for negotiating a short sale, unless the real estate licensee is also licensed as a loan originator by the Arizona Department of <a class="zem_slink" title="Financial institution" href="http://en.wikipedia.org/wiki/Financial_institution" rel="wikipedia">Financial Institutions</a> (“DFI”).</p>
<p>There may be more changes to come, so agents are advised to check with their brokers about their firm’s short sale policy.</p>

<p>The Helping Responsible Homeowners Act (S. 170), which aims to help underwater homeowners refinance their loans at historically low interest rates, is gaining support.</p>
<p><a href="http://boxer.senate.gov/" target="_blank">Sen. Barbara Boxer</a> (D-California) says her bill, which was introduced in January, is now being co-sponsored by <a href="http://isakson.senate.gov/" target="_blank">Sen. Johnny Isakson</a> (R-Georgia) who previously ran one of the largest independent real estate brokerages in the country.</p>
<p>The Helping Responsible Homeowners Act would eliminate current barriers blocking millions of non-delinquent homeowners from refinancing their mortgages at historically low interest rates.</p>
<p>The refinancing options <a href="http://www.fanniemae.com/kb/index?page=home" target="_blank">Fannie Mae</a> and <a href="http://www.freddiemac.com/" target="_blank">Freddie Mac</a> currently offer these homeowners come with high, up-front, risk-based fees – up to two percent of the loan amount – making them largely unpopular.</p>

<p>The proposed legislation would eliminate these fees for loans for which <a href="http://www.fanniemae.com/kb/index?page=home" target="_blank">Fannie Mae</a> and <a href="http://www.freddiemac.com/" target="_blank">Freddie Mac</a> already bear the risk.</p>
<p>The bill also aims to remove refinancing limits on underwater mortgages and allow these homeowners to receive interest rates comparable to other borrowers.</p>
<p>While mortgage rates remain historically low – below 5 percent – more than 8 million homeowners with loans guaranteed by Fannie and Freddie maintain rates at or above 6 percent.</p>
<p>Several industry groups and professionals have also endorsed the bill, including the <a href="http://www.namb.org/namb/Default.asp" target="_blank">National Association of Mortgage Brokers</a>, the National Consumer Law Center, the <a href="http://www.car.org/" target="_blank">California Association of Realtors</a>, the <a href="http://www.ca-amp.org/" target="_blank">California Association of Mortgage Professionals</a> William Gross, managing director and co-CIO of <a href="http://www.pimco.com/Pages/default.aspx" target="_blank">PIMCO</a>, and housing economist Thomas Lawler.</p>
<p>“The time to help struggling homeowners is now – while interest rates remain at near-historic lows,” Boxer said in a press conference call.</p>
<p>“This legislation would help millions of responsible homeowners who are making their payments, but are still struggling to make ends meet,” she continued. By helping these homeowners refinance at lower rates, we will put thousands of dollars back in the pockets of families and strengthen our economy.”</p>
<p>Ronald Phipps, president of the <a href="http://www.realtor.org/" target="_blank">National Association of Realtors</a> also spoke in strong support of the bill. Mark Zandi, chief economist at Moody’s Analytics was also on the press conference call.</p>

			<content:encoded><![CDATA[<h3>First the <strong>Safe Act</strong> had a say on it and now the <strong>Dodd Frank Act is out to sabotage <strong>Seller Financing</strong>.</strong><em></em></h3>
<p>The Dodd-Frank Bill would literally outlaw seller financing. The Federal Reserve, which received sweeping new authority under the Obama regulatory reauthorization, wants to effectively eliminate seller-held (a.k.a. purchase money) mortgages. It will do this by enacting a rule for the Dodd-Frank Act prohibiting property sellers from taking back a mortgage unless the buyer can qualify for conventional financing.</p>
<p>What&#8217;s more, MA and PA Homeowners, who create 95% of seller-held mortgages, won&#8217;t be able to qualify buyers under the same underwriting standards that banks are required to perform, and therefore the cash flow notes won&#8217;t be created.</p>
<p>If this is enacted it also will remove access to housing for millions of Americans, because seller financing is the only way people who can&#8217;t qualify for conventional loans can buy a house.</p>
<p>This rule also allows the buyer a three year right of rescission (they can cancel the sale) if the seller did not properly qualify them.  This right to rescission also applies to anyone who has bought the note.</p>
<p>Why would the government want to slow the housing rebound further by putting stringent restrictions on seller financing – one of the few alternatives to bank financing available in today’s struggling economy&#8230;???</p>
<p>And it’s not over yet.</p>
<p>The Federal Reserve is requesting comments on the proposed rule of the ability-to-repay.  NAR refers to it as Qualified Mortgage which appears on page 10 of the proposed rule.</p>
<p>This standard would be applied to seller financing.  It’s the same underwriting standards that banks are required to perform.  The bottom line is that the only people who will be able to use seller financing are the same people who would be able to qualify for conventional financing.</p>
<p><strong>Comments are due before or on July 22, 2011.  Please get the word out</strong>.</p>

<p>Foreclosures are claiming a smaller share of the Phoenix sales market.</p>
<p>The ratio has dropped for three straight months, according to a new report from the <a href="http://wpcarey.asu.edu/realestate/Phoenix-Resale-Market-Reports.cfm" target="_blank">W. P. Carey School of Business</a> at Arizona State University.</p>
<p>In May, foreclosures represented about 35 percent of the existing-home transactions in the Phoenix-area housing market. From January and February, the rate was 43 percent.</p>

<p>“Although the number of foreclosure pre-filings has been declining for the last several months, this trend is not unusual in the early part of any year with a typical pickup over the next few months,” said Jay Butler, associate professor of real estate.</p>
<p>“While any decline is positive,” Butler continued, “fundamental uncertainty remains as to whether foreclosures will cease to be the dominant force in the market.”</p>
<p>Butler explained several factors that could strongly influence the market in the future, such as ongoing discussions about stricter underwriting guidelines, inflationary concerns, changes in the secondary market, and possible lowering of the Federal Housing Administration mortgage limit. He also emphasizes the still-struggling job market and economy.</p>
<p>More than 3,500 foreclosures occurred in the Phoenix market in May, which is still up from approximately 3,200 last May. When foreclosures are added to the resales of previously foreclosed properties, they total 61 percent of the recorded activity in May.</p>
<p>The W. P. Carey School is one of the top-ranked and largest business schools in the United States.</p>
